In
1824 the United States Supreme Court ruled that any law passed by Congress, which is contrary to or is in direct violation of the United States Constitution is not a law. The Marshal Court,
as it is known, made this landmark decision, which remains the backbone of Constitutional Law in this country today.
Between 1932 and 1936 the Democratically controlled Congress attempted to side step
this Supreme Court ruling by enacting legislation restricting it powers and authority. In essence they passed legislation that was contrary to and in direct violation of the United States Constitution. President Roosevelt called this new legislation his "New Deal". Among the "New Deal" legislation was the creation of gun controls, the Social Security
Administration, the Veterans Administration (previously known as the Bureau of War Risk), social welfare and forced labor programs, and started the practice of levying taxes based upon a person’s private income. Then in 1937 the United States Supreme Court ruled the entire "New Deal" package to be unconstitutional. Almost immediately Roosevelt tried to stack the Supreme Court by adding additional judges who would over turn the earlier Supreme Court decision.
This angered most of people who had supported Roosevelt and his "New Deal". It also made a lot of Members of the Congress very angry with the Roosevelt Administration.
They did not get mad because Roosevelt's "New
Deal" was unconstitutional but rather at the way Roosevelt himself tried to Stack the Supreme Court. Many people still believe in and are fully prepared to protect any and all "New Deal" legislation no matter how unconstitutional it is.
Since 1938 the "New Deal" supporters have continued to pass Roosevelt’s "New Deal" legislation
through the United States Congress. In order to protect this unconstitutional legislation from any further Court review and Court challenges, as to their constitutionality, they have also placed individuals into Federal Judgeships who also support the "New Deal" and who hold to the belief that the Federal Government is a "Sovereign Power". Whose decisions are final and may not be reviewed or questioned in any manner by any Court of Law. (see our discussion on Section 511(a) of Title 38)
In doing so the Federal Courts and the Government have left out one very important fact, which is, the fact that it is We the People who hold the ultimate "Power" in this country. Therefore it is We the People who hold the real "Sovereign Power" and not the Government. It is We the People who make the final decision as to what is legal and what is not as well as what is constitutional and what is not. We exercise this power every day without most of us realizing it. An example of this is:
Over the last decade the IRS has been trying to get the Congress to pass legislation forcing people to pay their Income Taxes. The IRS estimates that some 3 million plus hardworking American Citizens do not pay any Income Taxes at all. What upsets the IRS is there is no way the Government can legally go after these Tax Dodgers" and force them to pay a tax based solely upon their income. Every time the IRS and the Treasury Department thinks they have one of these "Tax Dodgers" and they drag them into the Tax Court. They loose the case.
Why?
It is called the 4th, 5th, and 6th Amendments which protect the private citizen against unlawful search and seizure, prevents a person from being a witness against him or herself and guarantees every citizen their right to a fair and impartial trial. In other words the collection of taxes based solely upon a person’s private income is strictly voluntary. If a person does not participate in the system and dose not have his or her money withheld from their weekly paychecks and does not file a tax return there is nothing the IRS or the Treasury Department can do about it.
If this were the case than why are so many people paying it?
Ignorance.
That and if nobody paid any Income Taxes the Tax Lawyers would go broke within a month so they do not push the issue in the Court.
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable search and seizure, shall not be violated, and no
Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law ; nor shall private property be taken for public use, without just compensation.
In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and
district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the
Assistance of Counsel for his defense.
That means in simpler terms that you have certain inalienable Rights. Rights which the Federal Government, the Federal Courts,nor the United States Congress can take away from you. The only reason why they are presently doing it is because the majority of the people either out of ignorance or plan old fashioned apathy go along with the program. What is truly sad. Is every time a person has something happen to them like the IRS come in and illegally seize their personal property. That is when they, all of the sudden, become interested in finding out what their Rights really are. Only by that time it is already too late.
Every weekday the Department of Veterans Affairs Medical Staff execute on an average of 10 veterans per day in each of the Department’s 174 Medical Centers. This is in direct violation to the United States Constitution and the Nuremberg War Crimes Tribunal rulings. The Department has admitted that these unnecessary Veterans deaths are a direct result of exploratory surgery. This does not account for the number of Veteran deaths associated with mass injections of deadly drugs to make room for other Veteran patients, which the Department’s Medical Staff have been doing on older and more demanding Veteran patients. Nor does it account for the number of Veterans deaths after the Department Medical Staff have refused the Veterans proper medical treatment for their Service-Connected Disabilities and conditions.
The Department is also able to steal a Veteran's money by Administrative Procedure without any form of a trial or administrative hearing and without notifying the Veteran of a claimed debt prior to the Department’s actions against them. Now the Department is further able to steal a Veteran’s money by making up some bogus debt from some other government department or agency. All without any form of a trial, hearing or even without any prior notification of a claimed debt.
The United States Constitution was written by a group of people who had very little or no formal education. They did not know exactly what form of government they wanted but they were very sure of exactly what form of government they didn’t want. They knew that for this country to survive that a government of some form would have to be in place. They also knew that in order for Individual Rights and Freedoms
to remain free and the true power of government to remain in the hands of the People that the government would have to be under the absolute control of the People. It was for this reason they wrote the Constitution telling the government exactly what it could do and exactly what it cannot do. If something is not authorized by the Constitution, under the 10th Amendment the government is denied the authority to do it. Under the 9th Amendment when the government does something that is not constitutional then "We the People" have the Sovereign Power to ignore it or to challenge it in a Court of Law.
Therefore it is every citizen’s responsibility NO! Every citizen’s DUTY to read and understand the
United States Constitution. Every time a citizen or a group of citizens surrender their constitutional rights to the United States Government no matter how convenient it may be for either their own financial gain or simply because it is easier they are desecrating the sacrifices made by every person who has ever fought to protect and defend them and their Individual Rights.
